Terms and Conditions of Sale
1. General Provisions
1.1. These Terms and Conditions of Sale (hereinafter – the “Terms”) set out the mutual rights, obligations and responsibilities between UAB JEKPO (hereinafter – the “Seller”) and the customer (hereinafter – the “Buyer”) when purchasing goods in the online store at www.jekpo.com.

1.3. These Terms apply to all orders and form an integral part of the purchase agreement.
1.4. By placing an order, the Buyer confirms that:
a) they are at least 18 years old;
b) they act in their own name and do not intend to resell the goods without the Seller’s written consent;
c) they have read and agree to comply with these Terms.
1.5. The Seller may suspend or cancel an order if fraud is suspected, incorrect information has been provided, or force majeure circumstances prevent fulfillment of obligations.
2. Ordering and Payment
2.1. The Buyer selects goods on the website and submits an order.
2.2. Available payment methods:
Bank transfer
Credit / debit card (3-D Secure)
Leasing / financing (where applicable)
2.3. The order is considered accepted once the Seller confirms receipt of payment by email.
2.4. For large orders (> €10,000), the Seller may request additional identity or company documentation.
2.5. In the event of an unjustified chargeback, the Buyer shall compensate the Seller for 100% of the goods value plus 20% administrative costs.
3. Delivery of Goods
3.1. Delivery timeframe:
3–15 business days within Lithuania / 5–20 business days within the EU from payment confirmation.
3.2. Delivery methods:
Courier delivery
Delivery to distribution center
Warehouse collection (if applicable)
3.3. Delivery costs are calculated individually based on weight, dimensions and delivery address.
3.4. Ownership and risk transfer to the Buyer upon signing the CMR consignment note / delivery document.
Transport damage must be recorded at the time of delivery; otherwise, claims will not be accepted.
3.5. Unloading of non-standard equipment (>2 t or >2.4 m height) is at the Buyer’s expense and responsibility.
4. Returns and Warranty
4.1. Returns
B2C Buyers may withdraw from the contract within 14 calendar days.
Goods must be unused (<2 engine hours), undamaged and complete.
Depreciation: 1% per additional engine hour exceeding the limit or for aesthetic damage.
Goods will not be accepted if manufactured to individual order, used (>8 engine hours), or missing documentation.
The Buyer bears return transport costs, except in case of manufacturing defects.
4.2. Warranty
12 months or 1500 engine hours (whichever occurs first).
Warranty excludes naturally wearing parts: tracks, rollers, drive/idler sprockets, hydraulic hoses, filters.
Mandatory service at JEKPO service center: 40h / 100h / 300h.
Warranty becomes void if the equipment is modified, used for rental without consent, or serviced by unauthorized service providers.
Service timelines: diagnostics – 5 business days; repair – 15 business days (if parts are in stock).
5. Permitted / Prohibited Use
Permitted: Use in accordance with the operating manual.
Prohibited:
Illegal excavation works, self-performed structural repairs (welding, ECU tuning, pressure modifications), resale without license, handling hazardous materials without appropriate configuration, removal of CE markings.
Violations void the warranty and may result in liability for damages.
6. Personal Data Protection
6.1. Personal data is processed in accordance with the GDPR and applicable Lithuanian law.
6.2. Data processing purposes:
Order fulfillment
Invoicing
Delivery
Marketing (with consent only)
6.3. Data is shared only with logistics and payment service providers to the extent necessary.
6.4. Retention period: 5 years from the last purchase unless longer retention is required by law.
6.5. Buyer rights:

Rectification
Erasure
Restriction of processing
Object to direct marketing
7. Limitation of Liability
7.1. The Seller is not liable for indirect damages (lost profits, downtime).
7.2. The Seller’s maximum liability is limited to the purchase price of the goods.
7.3. In case of force majeure, the Seller is released from liability for non-performance.
7.4. The Buyer is responsible for compliance with laws regarding registration, road traffic regulations, occupational safety and environmental protection.
8. Intellectual Property
All texts, photographs, drawings and video materials are the property of JEKPO and may not be used without written permission.
9. Export / Import Control
The Buyer confirms that the purchase does not violate EU sanctions or dual-use regulations.
The Seller may suspend the order until all required permits are obtained.
10. Amendments and Disputes
10.1. The Seller may amend the Terms. The updated version applies only to orders placed after publication.
10.2. Disputes shall first be resolved through negotiation. If unresolved, disputes shall be settled in the Šiauliai District Court at the Seller’s registered office.
10.3. B2C Buyers may submit complaints to the Lithuanian Consumer Rights Protection Authority or via the EU Online Dispute Resolution platform:
